What is a privacy policy?

Privacy policy is a document that explains what all data is collected from you, how it is used and whether it is shared with other third-party services and for what purpose.


Why should you care? 

In the age of the internet, privacy has become somewhat of a “myth”. Millions of internet users expose their personal information without being aware of it while the companies make profits by selling your data to advertisers and other 3rd party companies that extract your persona and understand your online behavior. Especially if you are doing digital payments, your payment behavior such as how much you spend , where you spend, your spending patterns and habits can be potentially exposed and be misused.

We want to challenge this status quo set by large payment companies where “Data Farming” (Extracting your behavior) is a norm. We are on a mission to help Indians realize this and end their modern day slavery towards big companies who have access to our personal information and control our online behavior. We want to create this change by first securing our Payments data which is extremely sensitive.

India took the right step in this direction with the introduction of Rupay cards and it is now time for SuperPay to ensure the same for UPI payments - By Indians, For Indians.

THIS DOCUMENT (hereinafter referred to as the “Privacy Policy”) IS AN ELECTRONIC CONTRACT AS PER THE INFORMATION TECHNOLOGY ACT, 2000, AND THE RULES MADE THEREUNDER AND THE AMENDED PROVISIONS PERTAINING TO ELECTRONIC RECORDS IN VARIOUS STATUTES AS AMENDED BY THE INFORMATION TECHNOLOGY ACT, 2000. For the purpose of this Privacy Policy, wherever the context so requires "you" or "User" or “your” shall mean merchants or sellers or billers, customers or buyers or consumers, or any other person who accesses or uses our websites, applications and other services (collectively, our "Services" or “Platforms”).


This Privacy Policy will help you understand the types of information that We may collect from you, when you access or use our Services and practices for collecting, using, maintaining, protecting and disclosing that information.


By accessing or using our Services, you agree to this Privacy policy and expressly give Us the consent to use and disclose your information in accordance with this Privacy Policy. Superpay collects such information of yours which is necessary to operate our business and to deliver and improve our Services. We may obtain the following Information about you and the devices from which you use or access our Services.


Personal Information: For identifying you and facilitating some of our Services, We may require certain information such as your name, mobile number, email id, date of birth, location, contacts etc.

We also collect your contacts list to identify existing users of Superpay and give you a seamless payments experience. It may be also used to help you easily participate in our referral programs.

Transactional Information: To help you view your payment history and resolve your issues, We store transaction details such as amount, recipient details, date, time of transaction, etc.


Device Information: We may collect information such as mobile application version, operating system version, browser type etc. to further improve your app experience.


Your activities on our Platforms: Information about your activity while accessing or using our Services such as your search queries, number of clicks, error logs and other similar information to help improve your app experience.


Correspondence Information: When you send an email or any other communication to us, We may retain those communications in order to process your enquiries, respond to your requests and improve our Services.


Bank Account Details: To protect your privacy, we don’t store your bank account details in our systems and instead use the last few digits to identify your bank account.


 

WHAT DO WE DO WITH YOUR INFORMATION?

We use your information to identify you, to verify your Identity, to provide you with services & products you explicitly requested for, to resolve disputes, troubleshoot concerns, help promote safe services, inform you about offers, new products, new services, updates, customize your experience, detect & protect you from frauds and other criminal activities, and as otherwise described to you at the time of collection.

We collect your correspondence information to process your enquiries, communicate with you, respond to your requests, ask you to complete surveys and connect with for other such purposes that can help us improve our Services and serve you better.


DISCLOSURE OF INFORMATION

We do not disclose or distribute any of your information to a third party until essential for providing you our Services; or for the below purposes in accordance with this Privacy Policy.


We may share your information with parties such as payment processors, financial institutions. etc., to securely process your transactions. 


We may also disclose anonymized data derived from your information with third parties and affiliates to help Us detect and prevent identity theft, fraud and other potentially illegal acts; to correlate related or multiple accounts to prevent abuse of our Platforms; to comply with our legal obligations; to personalize and improve our Services. We do not disclose your information to third parties for their marketing and advertising purposes unless we receive your explicit consent.


If all or some of the business, stocks or assets of Superpay are acquired or merged with another business entity, We will share all or some of your information with this entity to continue to provide the Services to you. you will receive the notice of such an event and the new entity will inform you of any changes to the practices in this Privacy Policy. If the new entity wishes to make additional use of your information, you may decline such use at such time.


We may disclose your information if required to do so by law or in the good faith or belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal processes.

 

LINKS TO OTHER PLATFORMS

Our Platforms link to other third party platforms that may collect some information about you. Superpay is not responsible for the privacy practices or the content of those linked platforms.

 

SECURITY PRECAUTIONS

Superpay has implemented stringent security measures to protect the loss, misuse, and alteration of the information under our control.


The security of your Information also depends on your efforts to keep your account credentials confidential. you should not share your account password, pin, or any such information with anyone. It is your responsibility to control access to your mobile device and Superpay accounts. It is your responsibility to alert Us if you believe that the security of your information has been breached or compromised.


Notwithstanding anything contained in this Policy or elsewhere, Superpay shall not be held responsible for any loss, damage or misuse of your information, if such loss, damage or misuse is attributable to a Force Majeure Event (as defined below).


A Force Majeure Event shall mean any event that is beyond the reasonable control of Superpay and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, power or electricity failure or unavailability of adequate power or electricity.


 

UPDATING ACCOUNT INFORMATION

You can add or update your account information on a regular basis. Kindly note that Superpay would retain your previous personal information in its records.


 

CHANGES TO THIS POLICY

We reserve the right to change, modify, add or remove portions of the Privacy Policy, at any time without any prior written notice to you. It is your responsibility to review the Privacy Policy periodically for updates or changes. Once posted, those changes are effective immediately, unless stated otherwise. Continued access or use of our Platforms constitutes your acceptance of the changes and the amended Privacy Policy. However, if you do not agree with the changes, please do not continue to use or access our Services.


 

YOUR CONSENT AND OPTING OUT

You agree and acknowledge that you are providing your information out of your free will. You have an option not to provide or permit Superpay to collect your information or later on withdraw your consent with respect to the information provided herein by sending an email to our Legal Compliance officer or such other electronic address of Superpay. In such case, you should neither access or use our Service nor shall contact us.


 

JURISDICTION AND GOVERNING LAW

These terms and conditions shall be governed by and construed in accordance with the Indian laws. Any dispute arising under these terms and conditions shall be subject to the jurisdiction of the courts of India.
